Terms of Service

By using the Pelican Lockers mobile app or renting a locker through our service (the “Service”) — operated by Pelican Beach Resort Owners Association, Inc. (“we,” “us”) — you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to rent a locker. By using the Service you represent that you are 18 or older and legally able to enter into this agreement.

2. The Service

Pelican Lockers provides short-term rental of physical lockers operated by Pelican Beach Resort Owners Association, Inc. You browse available lockers in the app, pay a rental fee through Stripe, and unlock the assigned locker via Bluetooth from your phone for the duration of your rental.

3. Account and login

You log in with your phone number and a one-time code sent by SMS. You are responsible for keeping your phone, your phone number, and the app installed on your device secure. Anyone with access to your phone may be able to operate your account.

Successful rentals are non-refundable except where required by law. If a locker fails to open due to a hardware fault on our side, contact [email protected] for a refund.

6. Acceptable use

You may not store the following in any locker:

Violations may result in immediate termination of your rental, removal of contents, and reporting to law enforcement.

7. Your belongings

Items left in lockers are stored at your sole risk. Pelican Lockers does not insure stored property and is not liable for loss, theft, or damage to items inside the locker. We recommend you do not leave valuables, irreplaceable items, or items containing sensitive information.

8. Bluetooth and connectivity

To open a locker, your phone must have Bluetooth enabled and be within Bluetooth range of the locker hardware. You also need an internet connection at the time of rental to receive your unlock token. Pelican Lockers is not responsible for failures caused by network outages, dead batteries, or device incompatibility on your end.

9. Service availability

We make reasonable efforts to keep the Service running, but we provide it on an “as-is” basis without uptime guarantees. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

10. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, Pelican Beach Resort Owners Association, Inc., and its officers, directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our aggregate liability for any claim arising from your use of the Service is limited to the amount you paid us in the six months before the claim.

12. Indemnification

You agree to defend and hold harmless Pelican Beach Resort Owners Association, Inc., and its officers, directors, employees, and contractors from any claim arising out of your use of the Service, your violation of these Terms, or your violation of applicable law.

13. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Okaloosa County, Florida.

14. Changes to these Terms

We may update these Terms. The “last updated” date above will change, and continued use of the Service after the update constitutes acceptance of the revised Terms.
